By accessing or using our services, you agree to these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
2. User Accounts
When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the security of your account and password. FotoBill cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
3. Subscription and Payments
Some features of our service require a subscription. You agree to pay the fees associated with your subscription plan. Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change our subscription fees upon reasonable notice.
4. Recurring Subscription Payments
By subscribing to our services, you authorize FotoBill to automatically charge the subscription fee to your payment method at the end of each subscription period. Payments will be processed using the primary payment method you provided during your initial subscription. To disable automatic renewals, you may log into your account, navigate to Subscription Settings, and disable the auto-pay option. Please note that disabling auto-pay must be done at least 24 hours before your next billing cycle to prevent charges for the upcoming period.
5. Intellectual Property
The content, features, and functionality of FotoBill, including but not limited to text, graphics, logos, and software, are owned by FotoBill and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit permission.
6. User Content
You retain ownership of any content you upload to our platform. However, by uploading content, you grant FotoBill a non-exclusive, worldwide, royalty-free license to use, store, and display your content for the purpose of providing our services. You are solely responsible for the content you upload and must ensure it does not violate any third-party rights.
7. Limitation of Liability
FotoBill and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. In no event shall our total liability exceed the amount you paid for our services in the six months preceding the event giving rise to the liability.
8. Termination
We may terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on our website and updating the “Last Updated” date. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
11. Data Visibility and Shared Data
As FotoBill is a team collaboration platform, certain information from your profile may be visible to other users within your organization or team. Your profile data, including your name, profile picture, role, and other professional information, may be displayed to other users as part of your public profile. By using our services, you acknowledge and consent to this sharing of information within the platform for collaboration purposes.
